ประสบการณ์การดำเนินการ CR-1 ตอนที่ 3: การดำเนินการขั้น NVC

มาต่อกันตอนที่ 3 เลยนะคะ เขียนกันแบบมาราธอนไปเลย ตอนนี้เรามาว่ากันเรื่องของขั้น NVC กันค่ะ

หลังจากรอกันมาอย่างยาวนานในขั้น USCIS แล้ว หลายคนคงยิ้มออกเมื่อได้ NOA2 ซึ่งมันหมายถึงว่าเคสกำลังจะถูกส่งไป NVC แล้ว พอมาถึงขั้น NVC แล้ว เคสเราจะเดินหน้าไปเร็วมาก ซึ่งถ้าใครตั้งตัวไม่ติดเตรียมเอกสารหรือดำเนินการไม่ทันก็อาจทำให้ใช้เวลามากเกินกว่าที่ควรจะเป็นได้ ในเคสเราใช้เวลานับแต่ได้รับแจ้ง case number ไปจนถึง ได้รับวันสัมภาษณ์แค่เดือนเดียวเองค่ะ

เอา timeline มาแปะให้ดูอีกทีนะคะ ซึ่งตัดมาจากตอนแรกที่ได้เขียนไว้ โดยที่บรรทัดที่อยู่ภายในเส้นประ คือ ขั้นตอนนับจากที่ได้แจ้ง case number จนถึงวันที่ได้รับแจ้งวันสัมภาษณ์ค่ะ ซึ่งก็คือวันที่ 11 June 2012 - 11 July 2012

ที่นี้เรามาดูว่าเมื่อได้รับ case number แล้วต้องทำอะไรบ้าง จะได้เตรียมตัวไว้ก่อน

เชื่อว่าแต่ละเคสอาจไม่เหมือนกันเป๊ะๆ แต่เคสเราได้อีเมล์แจ้ง NOA2 ต้นเดือน พ.ค. ถ้าจำไม่ผิดตอนนั้นแฟนไปสัมมนาอยู่แคนาดา กลับบ้านถึงได้เจอ NOA2 มานอนรออยู่แล้ว ก็จัดการ scan ส่งอีเมล์มาให้เรา เพื่อไปดำเนินการขอใบรับรองความประพฤติที่สำนักงานตำรวจแห่งชาติ

ทีนี้ระหว่างนี้ควรทำอะไรบ้าง บอกได้เลยว่าให้เตรียมไปขอใบรับรองความประพฤติมาไว้ในครอบครองก่อนเลย เพราะใช้เวลาในการทำประมาณ 3 อาทิตย์

1. การขอใบรับรองความประพฤติ
การขอใบรับรองความประพฤตินี้เราเคยเขียนแชร์ประสบการณ์ไว้ที่ usvisa4thai.com แต่ปัจจุบันเว็บเจ๊งๆ เปิดอ่านไม่ได้แล้ว ขอเขียนที่นี่คร่าวๆ ละกัน เพราะจำไม่ค่อยได้แล้ว

เอกสารที่ใช้ (สามารถขอได้เลยโดยไม่ต้องรอ case number จาก NVC นะคะ)
- สำเนา NOA2 (NOA1 ก็ใช้ได้ค่ะ)
- สำเนาทะเบียนสมรส
- สำเนาพาสปอร์ตสามี
- สำเนาทะเบียนบ้าน
- พาสปอร์ตเรา
- ใบเปลี่ยนนามสกุล

การเดินทาง เราไปจากที่ทำงานแถวแจ้งวัฒนะก็เดินทางไปต่อ BTS ที่หมอชิต ลงสถานีสยาม (จริงๆ เดินทางง่ายมาก เพราะเราไปตึก 33 ที่อยู่ข้างๆ ตึก 24 ที่ออกทะเบียนประวัติบ่อยๆ) แล้วเดินเข้าไปใน สตช. มุ่งหน้าไปตึก 24 ไปถึงก็ติดต่อโต๊ะด้านหน้าเลยค่ะ เค้าจะมีคุณตำรวจคอยซักถามเราว่า ต้องการทำอะไรแล้วก็จะขอดูเอกสารที่เราเตรียมไปว่าครบถ้วนถูกต้องหรือไม่ และให้แบบฟอร์มเรามาเขียน กรอกเสร็จก็จะไปพิมพ์ลายนิ้วมือ ถ่ายรูป เสร็จเรียบร้อยติดต่อ จนท. ที่โต๊ะและเค้าจะออกใบรับให้ค่ะ กรณีที่จะไปรับเองจะรู้วันเลยว่าจะได้วันไหน ของเราใช้เวลา 3 อาทิตย์ถึงได้

ทีนี้ขอเล่าที่จำได้นิดนึง ไว้เป็นข้อมูลสำหรับคนที่จะไปขอสำหรับ CR-1 คือ ในใบคำร้องขอใบรับรองความประพฤติที่เราต้องกรอก เค้าจะถามว่าเราจะเอาไปใช้ทำอะไร มีให้เลือก 3-4 อย่าง จำได้ว่ามี เพื่อไปศึกษาต่อ เพื่อย้านถิ่นที่อยู่ เพื่อไปสมรส และเพื่อทำงานในต่างประเทศ เราแต่งงานแล้วและจะใช้ย้ายไปเมกาด้วย CR-1 เลยติ๊กเลือกเพื่อย้ายถิ่นที่อยู่

ทีนี้พอพิมพ์ลายนิ้วมือและถ่ายรูปอะไรเสร็จสรรพ ก็ต้องมานั่งคุยกับ จนท. ที่เก็บเอกสารเราไปดำเนินการ เค้าอ่านแบบคำร้องเรา และดูเอกสารประกอบของเราที่แนบไป และถามว่าเรามี case number มาด้วยมั้ย เราบอกว่ายังไม่ได้ case number เลยค่ะ คุณ จนท. ตำรวจ ก็บอกว่า งั้นแก้เป็นเอาไปเพื่อสมรสละกัน เราก็บอกว่าแต่เราสมรสแล้วนะ คุณตำรวจก็ตอบว่า ไม่เป็นไร มันเป็นเรื่องทางธุรการเฉยๆ ในส่วนนั้น ใบรับรองความประพฤติที่จะออกมาไม่ว่าจะขอไปเพื่ออะไรข้อความทุกอย่างจะเหมือนกันหมด ว่าเรามีประวัติหรือไม่ เราจะเอาไปทำอะไรก็ได้ ที่ต่างกันก็แค่เอกสารประกอบการขอ เช่น ถ้าจะขอไปทำงานก็ต้องแนบเอกสารเกี่ยวกับการทำงานไปพร้อมกับคำร้องขอใบรับรองความประพฤติ เป็นต้น คุณตำรวจบริการดีและใจดีมากๆ เลยค่ะ ตอนนั้นเราไม่เสียตังค์สักบาท แต่ถ้าดูจากเว็บไซต์ที่ให้ไว้ข้างบน ปัจจุบันนี้มีค่าธรรมเนียมแล้วนะคะ 100 บาทเองค่ะ

การรับใบรับรองความประพฤติด้วยตัวเอง ควรโทรไปถามก่อนค่ะ เพื่อคอนเฟิร์มว่าเอกสารเราพร้อมแล้ว จะได้ไม่เดินทางเสียเที่ยว เบอร์โทรจะอยู่ในใบรับค่ะ

2. การชำระ fee และส่งเอกสารชุด AOS และการส่ง DS-3032
ในขั้นนี้ เรากับสามีได้รับอีเมล์จาก NVC กันคนละ 1 ฉบับค่ะ เนื้อหาเหมือนกันทุกอย่าง แต่ชื่อผู้รับในเอกสารที่แนบมาไม่เหมือนกัน  และจุดมุ่งหมายต่อผู้รับแต่ละคนก็ไม่เหมือนกัน ดังนี้ค่ะ
          - ฉบับที่แฟนได้รับ ชื่อผู้รับคือแฟนเรา ประกอบด้วยรายละเอียดการจ่าย AOS fee bill แต่มีสำเนา DS-3032 แนบไปด้วย จุดมุ่งหมายคือให้แฟนจ่าย AOS fee bill และส่งเอกสารชุด AOS ค่ะ
          - ฉบับที่เราได้รับ ชื่อผู้รับคือเรา ประกอบด้วยรายละเอียดการจ่าย AOS fee bill เหมือนกัน มีแบบฟอร์ม DS-3032 แนบมาเหมือนกัน จุดมุ่งหมายคือให้เราส่ง DS-3032 ค่ะ

เมื่อมาถึงขั้นตอนนี้แล้ว สิ่งที่เราต้องดำเนินการต่อไปแบ่งได้เป็น 2 อย่าง ตามนี้
1. สามีดำเนินการ
      1.1 log in เข้าไปจ่าย AOS fee bill ในระบบจ่ายออนไลน์ และ
      1.2 จัดส่งเอกสารชุด AOS หรือ Affidavit of Support
2. ตัวเราดำเนินการ ส่ง DS-3032 ไปให้ NVC ทางอีเมล์

อธิบาย
1. สามีดำเนินการ
      1.1 การจ่าย AOS fee bill
log in เข้าระบบจ่ายออนไลน์ที่ https://ceac.state.gov/CTRAC/Invoice/signon.aspx ซึ่งในการ log in นี้สิ่งที่ต้องใช้ คือ case number และ IIN (Invoice ID Number) โดยสามารถหาเลขทั้งสองนี้ได้ในอีเมล์ที่ได้จาก NVC นั่นเอง

ส่วนที่ต้องกรอกจะมี 3 ช่อง คือ I am the เพื่อบอกว่าเราเกี่ยวข้องกับเคสนี้อย่างไร มีให้เลือก 4 อย่าง คือ Principal Applicant, Attorney, Petitioner และ Third-party Agent ซึ่งหากเรา log in เองก็ให้เลือก Principal Applicant หากสามีเป็นคน log in ให้เลือก Petitioner กรณีจ้างทนายและทนายเป็นผู้ log in ก็เลือก Attorney ส่วนบรรทัดที่ 2 ให้ใส่ Case Number และบรรทัดสุดท้ายใส่ IIN จากนั้นคลิก Sign in

เมื่อ log in ได้แล้ว จะเห็นหน้าตาประมาณนี้

ซึ่งจากภาพจะเห็นว่ามีรายการขึ้นอยู่ 2 รายการที่ต้องจ่าย คือ AOS fee และ IV fee ในขั้นตอนนี้จะมีเพียง AOS fee เท่านั้นที่สามารถคลิกไปทำการจ่ายเงินได้ ปัจจุบันอยู่ที่ $88

เมื่อดำเนินการจ่ายเรียบร้อยแล้ว ให้สามีทำการกดปุ่ม Print Document Cover Sheet เพื่อทำการ print barcode sheet ออกมา ซึ่งในการส่งเอกสารชุด AOS จะต้องใช้ใบนี้ปะหน้าเอกสาร NVC จะนำเอกสารเราเข้าระบบโดย scan จาก barcode บนกระดาษแผ่นนี้ หากไม่แนบกระดาษแผ่นนี้ไปอาจทำให้เคสล่าช้าได้ เนื่องจากอาจต้องใช้เวลาในการตรวจสอบมากกว่าปกติ

      1.2 ส่งเอกสารชุด AOS
เอกสารที่สามีเราส่งไปกับชุด AOS มีดังนี้
               1) Barcode sheet ที่ print ออกมาจากระบบจ่ายเงินออนไลน์
               2) แบบฟอร์ม I-864EZ (I-864  มีหลายแบบ เลือกใช้ตามกรณี สามารถอ่านรายละเอียด I-864 แบบต่างๆ ได้ที่ http://travel.state.gov/visa/immigrants/info/info_3197.html)
               3) tax return, W2 ปีล่าสุดปีเดียว
               4) หนังสือรับรองการทำงานจากบริษัทที่สามีทำอยู่
               5) จดหมายปะหน้าที่เราทำขึ้นเอง เพื่อบอกโดยสรุปว่าเราเคสอะไรและส่งอะไรมากับ package นี้บ้าง จะทำหรือไม่ทำก็ได้ แต่ทำเพื่อความเรียบร้อยและง่ายต่อ จนท. ในการตรวจสอบด้วยความรวดเร็ว ตัวเองจดหมายปะหน้า ตามนี้

2. ตัวเราดำเนินการ ส่ง DS-3032 ทางอีเมล์
การส่ง DS-3032
ที่เจาะจงว่าทางอีเมล์เพราะเคสเราใช้การส่งทางอีเมล์ค่ะ โดยจริงๆ แล้วการส่ง DS-3032 สามารถทำได้ 2 ช่องทาง ซึ่งอาจเลือกทำอย่างใดอย่างหนึ่ง หรือจะทำทั้งสองทางควบคู่กันก็ได้ ได้แก่
          1) การส่ง DS-3032 ทางไปรษณีย์ สามารถทำได้ 2 อย่าง คือ print แบบฟอร์มจากอีเมล์ที่ได้จาก NVC ออกมากรอกและส่งไปทางไปรษณีย์ และใช้แบบฟอร์มที่ NVC ส่งมาให้ที่บ้านเราที่ไทยทางไปรษณีย์ ซึ่งอาจใช้เวลานานมากกว่าจะมาถึง อย่างของเคสเรามันมาถึงเอาปลายเดือน ก.ค. ซึ่งเราได้วันสัมภาษณ์แล้วเรียบร้อย เพราะเราส่ง DS-3032 ไปก่อนแล้วทางอีเมล์ หากรอแบบฟอร์มนี้ทางไปรษณีย์ คงจะได้วันสัมภาษณ์ปลายปีเป็นแน่
          2) การส่ง DS-3032 ทางอีเมล์ ทำได้ง่ายมาก ไม่จำเป็นต้องใช้แบบฟอร์มอะไรทั้งสิ้น เพียงแค่พิมพ์เป็นข้อความส่งไปถึง NVC ทางอีเมล์ที่ nvcinquiry@state.gov โดยใช้ subject ว่า "DS-3032, หมายเลข Case Number, ชื่อเราคู่สมรสชาวไทย" ส่วนเนื้อหาในอีเมล์ก็ copy ข้อความด้านล่างนี้ไปปรับเปลี่ยนเอาได้เลย

3. การจ่าย IV fee bill และการส่ง IV package (หรือที่เราชอบเรียกกันว่า pack 3)
หลังจากส่ง DS-3032 แล้วให้ลอง log in เข้าไปที่ระบบจ่ายเงินออนไลน์บ่อยๆ ดูค่ะว่าระบบปลดล๊อกให้เราเข้าไปคลิกจ่าย IV fee ได้หรือยัง

ของเคสเรา หลังจากอีเมล์ DS-3032 ไป NVC ได้ 9 วัน เราก็ได้รับอีเมล์แจ้งว่า NVC ได้รับและดำเนินการ DS-3032 ของเราแล้ว จากนั้นวันรุ่งขึ้นพอเรา log in เข้าระบบจ่ายเงินออนไลน์ IV fee ก็สามารถคลิกเข้าไปจ่ายได้แล้วค่ะ ถ้าจำหน้าตาระบบ log in ไม่ได้ เลื่อนขึ้นไปดูด้านบนนะคะ

การส่งเอกสารชุด IV package หรือ Pack 3
เมื่อทำการจ่าย IV fee แล้วก็ให้ทำการกด Print Document Cover Sheet ออกมาเหมือนที่ทำให้ขั้น AOS ค่ะ แต่คราวนี้คนที่ต้อง print ออกมาเป็นคุณเองที่เป็นคู่สมรสชาวไทยค่ะ

เอกสารชุด IV package ที่เราส่งไปมี ดังนี้
               1) barcode sheet ที่ print จากระบบจ่ายเงินออนไลน์
               2) แบบฟอร์ม DS-230 Part I กรอกและเซ็นต์ชื่อให้เรียบร้อย
               3) แบบฟอร์ม DS-230 Part II กรอก แต่ไม่ต้องเซ็นต์ชื่อ เนื่องจากต้องเซ็นต์ต่อหน้าท่านกงสุลในวันสัมภาษณ์
               4) รูปถ่าย 2x2 นิ้ว 2 ใบ
               5) สำเนาพาสปอร์ตหน้าที่มีรูปเรา
               6) ใบเกิดตัวจริงและสำเนา (ไม่ต้องแปล)*
               7) ทะเบียนสมรสตัวจริงและสำเนา (ไม่ต้องแปล)*
               8) ใบรับรองความประพฤติตัวจริงและสำเนา (ไม่ต้องแปล)*
               9) ใบเปลี่ยนชื่อบิดา, มารดาตัวจริงและสำเนา หากมี (ไม่ต้องแปล)*
               10) จดหมายปะหน้าที่เราทำขึ้นเอง เพื่อบอกโดยสรุปว่าเราเคสอะไรและส่งอะไรมากับ package นี้บ้าง จะทำหรือไม่ทำก็ได้ แต่ทำเพื่อความเรียบร้อยและง่ายต่อ จนท. ในการตรวจสอบด้วยความรวดเร็ว ตัวเองจดหมายปะหน้า ตามนี้

* กรณีสัมภาษณ์ในประเทศไทย หากเอกสารที่ใช้เป็นภาษาไทย หรือเป็นภาษาอังกฤษอยู่แล้ว (เช่น จดทะเบียนสมรสนอกประเทศไทยโดยทะเบียนสมรสที่ได้เป็นภาษาอังกฤษ เป็นต้น) ไม่ต้องทำการแปลเอกสารเป็นภาษาอังกฤษ

เมื่อเตรียมเอกสารครบเรียบร้อยและสามารถ print barcode sheet จากระบบจ่ายเงินออนไลน์ได้แล้ว เราสามารถที่จะส่งเอกสารชุด IV นี้ไปยัง NVC ได้ทันที เคสเราใช้ DHL ในการส่ง ทำการส่งด่วน การันตี 3 วันถึง

หากดูจาก timeline ที่เราโพสต์ไว้ด้านบนจะเห็นว่า เอกสารเราไปถึงก่อน AOS ของแฟน 1 วัน ซึ่งหลังจากที่เราส่งเอกสารที่ไทยได้ 13 วัน เราก็ได้อีเมล์ checklist จาก NVC ว่า NVC ได้รับเอกสารชุด IV ของเราแล้ว แต่ยังขาด AOS ของแฟน ซึ่งส่วนนี้แฟนเราได้รีบโทรไปถาม NVC เนื่องจากได้ส่งเอกสารไปครบหมดแล้ว ก็ได้ความว่า NVC อาจใช้เวลาถึง 10 วันในการแกะเอกสารที่ส่งถึง NVC เนื่องจากแต่ละวัน NVC ได้รับเอกสารเป็นจำนวนมาก ทำให้มีเอกสารที่เข้าคิวรอแกะซองเยอะ เรากะแฟนก็รอโดยไม่ได้ทำอะไร จากนั้น 2 วันก็ได้อีเมล์แจ้งวันสัมภาษณ์ค่ะ

ในส่วนของขั้นตอนนี้ของเราก็มีเท่านี้ ขอให้เพื่อนๆ ที่กำลังดำเนินการอยู่โชคดี และเคสเดินหน้าไวไวนะคะ ส่วนเอนทรีหน้าเราจะเขียนตอนที่ 4 ต่อ เป็นเรื่องของการเตรียมตัวสัมภาษณ์ค่ะ

ปล. พวก template หนังสือปะหน้าหรืออีเมล์ส่ง DS-3032 ที่เราแชร์ไว้ใน entry นี้ เราใช้วิธี capture จากไฟล์ word มาแปะ เพราะจะได้ไม่ต้องยุ่งยากกับการจัดรูปแบบบรรทัด ย่อหน้าต่างๆ ถ้าใครอยากได้ไปใช้แต่ขี้เกียจพิมพ์เองติดต่อมาได้นะคะ  comment ใต้ entry (ทิ้งอีเมล์ไว้ด้วยนะคะ) หรือคลิกที่ Contact ที่ Menu Bar หรือจะติดต่อมาทาง facebook ก็ได้ค่ะ

ประสบการณ์การดำเนินการ CR-1 ตอนที่ 1: ภาพรวม timeline และการเริ่มยื่น CR-1 ขั้น USCIS

เนื่องจากเดือนนี้ของปีที่แล้วเป็นช่วงที่เราอยู่ในขั้นตอนที่ได้รับ case number จาก NVC และดำเนินการจ่าย fee ของ AOS และ IV package และดำเนินการเตรียมเอกสารและส่ง IV package เลยจะขอถือโอกาสนี้เขียนแชร์ประสบการณ์การดำเนินการ CR-1 ของเรานับตั้งแต่เริ่มยื่นจนจบได้วีซ่ามาครอบครองนะคะ แต่เนื่องจากอาจจะเป็นเอนทรีที่ยามมาก เลยจะขอเขียนแยกเป็นตอนๆ ละกัน

ขอเริ่มด้วยการโพสต์ Timeline ก่อนละกันนะคะ
เคสเราใช้เวลารับแต่เริ่มยื่นจนถึงวันได้วีซ่าประมาณ 7 เดือนครึ่งค่ะ

เราได้สมัครเป็นสมาชิกเว็บไซต์ visajourney.com ไว้ด้วย ซึ่งเค้ามีเครื่องมือให้สร้าง timeline ได้เพียงแค่กรอกวันที่ต่างๆ ลงไป หน้าตา timeline ที่ visajourney เป็นแบบนี้ค่ะ

โดยการเริ่มยื่น CR-1 นั้นมีเงื่อนไข คือ ต้องจดทะเบียนสมรสกับชาวอเมริกันไม่เกิน 2 ปีนับจากวันที่เริ่มยื่นขอ CR-1 เพราะฉะนั้น เพียงแค่จดทะเบียนสมรสเรียบร้อย มีใบทะเบียนสมรสไว้ในครอบครองแล้วก็สามารถยื่นขอ CR-1 ได้เลยค่ะ

เราแต่งงานเดือน ต.ค. 2011 ช่วงนั้นเกิดเหตุการณ์น้ำท่วมใหญ่พอดีค่ะ พอแต่งเสร็จเราเลยเดินทางไปๆ มาๆ เมกาอยู่ 2 รอบ เพราะที่ทำงานปิดเนื่องจากน้ำท่วมเป็นเดือน ประกอบกับเราได้ยื่นขอลาไปต่างประเทศไว้ก่อนหน้านั้นด้วยแล้วเพื่อจะไปฉลองคริสมาสต์กับปีใหม่กับแฟนที่เมกา

เพราะฉะนั้นตอนที่เรากับแฟนเริ่มยื่น CR-1 เป็นช่วงที่เราอยู่อเมริกาพอดีค่ะ เราใช้วิธีส่งเอกสารที่ต้องใช้ส่งไปพร้อม I-130 ไปที่อยู่แฟนทางไปรษณีย์ เผื่อโดนค้นกระเป๋าตอนเข้าเมกาจะได้ไม่สงสัยว่าเราจะเข้าไปอยู่เลยแล้วปรับสถานะหรืออะไรทำนองนั้น เพราะตอนนั้นเราเดินทางเข้าเมกาด้วยวีซ่าท่องเที่ยวในชื่อสกุลก่อนแต่งงาน

เอกสารที่ต้องส่งในขั้น USCIS นี้ หลักๆ ก็มีแบบฟอร์ม 2 อัน คือ

- I-130

- G-325A

โดย I-130 นี้ใช้ 1 ชุดต่อหนึ่งเคส ส่วน G-325A ใช้ 2 ชุด คือสามีกรอกชุดนึง และเรากรอกชุดนึงของใครของมัน รายละเอียดเกี่ยวกับแบบฟอร์ม ดาวน์โหลดแบบฟอร์มและ fee สำหรับขั้นตอนนี้สามารถไปดูได้ ที่นี่ 

เอกสารที่ใช้ส่งพร้อม I-130 นี้ให้ยึดตาม instructions ของ I-130 เป็นหลัก ให้ส่งให้ครบตามที่ instructions บอก ห้ามขาดเพราะจะถูกเรียกเอกสารเพิ่มทำให้เสียเวลาออกไปอีก และถ้าไม่จำเป็นก็ไม่ต้องส่งอะไรเกิน เพราะอาจเป็นประเด็นให้ จนท พิจารณามากขึ้น และอาจทำให้เสียเวลาได้เช่นกัน

ส่วนของเราตอนนั้น เอกสารที่เราส่งไปทั้งหมดแยกออกได้เป็น 3 ส่วน คือ

1. เอกสารของแฟนชาวอเมริกัน

          - G-325A กรอกและเซ็นต์เรียบร้อย

          - birth certificate

          - divorce decree

          - รูปถ่าย 2x2 นิ้ว 1 ใบ

2. เอกสารของเราชาวไทย

          - G-325A กรอกและเซ็นต์เรียบร้อย

          - รูปถ่าย 2x2 นิ้ว 1 ใบ

3. เอกสารร่วม

          - I-130 กรอกและเซ็นต์เรียบร้อย

          - เช็คสั่งจ่ายค่าธรรมเนียม I-130 (ดูรายละเอียดการจ่ายและจำนวนเงินใน instructions ของ I-130)

          - สำเนาใบสำคัญการสมรส (ใบกรอบดอกไม้)

          - ใบแปลใบสำคัญการสมรสเป็นภาษาอังกฤษ แปลและรับรองโดยเราเอง ตัวจริง

          - สำเนาหนังสือสัญญาเช่าอพาร์ทเม้นต์และตึกที่อยู่ร่วมกันที่ไทย (ส่วนนี้อยู่ในส่วนของเอกสารแสดงความสัมพันธ์ ซึ่งมีระบุใน instructions ของ I-130)

รวมรวมเอกสารเสร็จเรียบร้อยเราก็ส่งไป USCIS ตามที่อยู่ที่ระบุใน instructions ของ I-130

หลังจากเราส่ง I-130 ได้ 9 วันก็ได้รับ NOA 1 ซึ่งเป็นจดหมายที่ส่งมายังที่อยู่แฟนค่ะ ซึ่งจะมีเลข receipt number ที่ขึ้นต้นด้วย WACxxxxxxxxxx โดยเราสามารถนำเลขนี้ไปเช็ค case status ในขั้นของ USCIS ได้ที่ https://egov.uscis.gov/cris/Dashboard/CaseStatus.do ค่ะ

CR-1/IR-1 Process for US Citizen's Spouse

เอนทรีนี้เขียนเป็นภาษาอังกฤษนะคะ เคยเขียนให้สามีอ่านตอนกำลังทำ CR-1 แต่เพิ่งได้เอามาเขียนใหม่ทั้งหมดเพราะมีเพื่อนของสามี (ชายชาวออสเตรเลีย) มีภรรยาเป็นอเมริกันและกำลังจะแต่งงานและเดินเรื่อง CR-1 เราเลยเขียนเรียบเรียงใหม่ทั้งหมดเป็นภาษาอังกฤษจากประสบการณ์เราโดยตรง โดยเราพยายามเขียนให้เข้าใจง่ายและสับสนน้อยที่สุด ก็เลยเลือกอธิบายตาม Timeline ของเรานะคะ เพราะงั้นสำหรับมือใหม่หรือใครที่อ่านที่อื่นมาแล้วรู้สึกสับสนว่าต้องทำอะไรตอนไหน ก็แค่ทำตาม Timeline เราได้เลยค่ะ รับรองไม่สับสนแน่นอน

เพราะงั้น ใครที่กำลังจะเดินเรื่อง CR-1 ก็เอาเอนทรีนี้ให้ภรรยาหรือสามีชาวเมกันอ่านได้เลยค่ะ แต่อย่างที่บอกว่าเป็นการเรียบเรียงแก้ไขใหม่จากการเขียนให้เพื่อนชาวออสซี่ที่มีภรรยาเมกันอ่าน เพราะงั้นเพื่อให้เข้าใจง่ายไม่สับสน ขอนิยามความหมายของคำเรียกบางคำ ดังนี้
alien spouse, he/she, him/her, your spouse, beneficiary = สามี/ภรรยาของชาวอเมริกันซิติเซ่น (ซึ่งหมายถึงตัวคุณที่เป็นคนไทยหรือเป็นคนชาติอื่นๆที่ไม่ใช่อเมริกันนะคะ)
you, petitioner = ตัวสามีหรือภรรยาของคุณที่เป็นชาวอเมริกันที่ต้องเดินเรื่องขอวีซ่าให้คุณค่ะ
หมายเหตุ - CR-1/IR-1 ในที่นี้เป็นการขอแบบคู่สมรสชาวอเมริกันยื่นเรื่องที่อเมริกานะคะ

I am writing this in English because a friend of my husband who is an australian and about to marry to an american woman asked me to give him some info on doing a spouse visa. I wrote him my experience on doing my CR-1 so this article will be from my own experience to him. Anyway I rewrote it here for any thai resident to give this to his/her US spouse to read and know about the visa.

Here are definition of words used in this article,
alien spouse, he/she, him/her, your spouse, beneficiary = US citizen's husband or wife
you, petitioner = US citizen

CR-1 / IR-1 Visa (Immigration Visas for Relatives) 

CR1
          - Is for a husband or wife of a US citizen who has been married for less than 2 years.
          - Provides the alien spouse a 2 years green card and a social security number once she/he enters
            the US with this visa. Both card will be automatically sent to his/her address in the US within a
            month after he/she enters the US.
          - After the alien spouse has lived in the US for 2 years with the 2 years green card, he/she can
            file for a new 10 years green card if he/she is still married to the same US citizen.
          - After the alien spouse has been a green card holder for 3 years and living in the US for over 18
            months out of those 3 years, he/she can take a test to be a citizen.

IR1
          - Is the same as CR1 but for a husband or wife of a US citizen who has been married for over 2
            years.
          - Provides the alien spouse a 10 years green card and a social security number once he/she enters
            the US with this visa. Both card will be automatically sent to his/her address in the US within a
            month after you enter the US.
          - After he/she has been a green card holder for 3 years and living in the US for over 18 months
            out of those 3 years, he/she can take a test to be a citizen.

note: This is written by me who is a Thai so "I" means me. And in the timeline, M is me and H is my US husband.

Explanations 
2012 Jan 05           I-130 Package sent to USCIS by H
The first thing to do is you and your alien spouse prepare a package together called I-130 package. US citizen is the person who will file the case and send the package. If the alien spouse is outside of the US at that time, tell him/her to mail all the documents needed from him/her to you and you will send them along with documents needed from you to USCIS.

2012 Jan 06           I-130 Package received by USCIS 
2012 Jan 08           Receipt Notice (NOA1) issued by USCIS 
2012 Jan 14           NOA1 received in H’s mailbox 
Once USCIS receives your I-130 package, the Receipt Notice will be issued. This notice is also called NOA1.
USCIS will mail NOA1 (I-797 or I-797C: Receipt Notice) to the US citizen’s address. This step could take from a few days to a few weeks.
Use the Receipt Number on NOA1 to check your case status online at https://egov.uscis.gov/cris/Dashboard.do

2012 May 09           Approval Notice (NOA2) issued by USCIS 
2012 May 12           NOA2 received at H’s address 
Once your case is done at USCIS, NOA2 (I-797 or I-797C: Approval Notice) will be issued and mailed to the US citizen’s address. This step could take from 2.5-5 months from the date you send the I-130 package to USCIS. All the documents from USCIS will be transferred to NVC now.
Once the you receive the NOA2, scan it and e-mail it to your alien spouse. He/She will need it to get police clearance certificate.

2012 May 21         M requested for police certificate at Royal Thai Police 
2012 Jun 06           Police certificate picked up at RTP by M
I brought a copy of NOA2 to Royal Thai Police to make a request for a police certificate. Be careful and get it ready as soon asap because it will take at least 3 weeks to get it. Check with the US embassy un BKK website for the instructions on how to get a police certificate. ขออธิบายเป็นไทยด้วยแล้วกันนะคะ เพราะส่วนนี้เราที่เป็นคนไทยต้องเป็นคนดำเนินการ
การไปขอใบรับรองความประพฤติจากตำรวจ จะต้องใช้ NOA2 ซึ่งสามี/ภรรยาชาวอเมริกันจะต้องทำการสแกนและส่งอีเมล์มาให้เรา เนื่องจาก NOA2 นี้จะเป็นกระดาษที่ NVC ส่งไปที่บ้านของคู่สมรสชาวอเมริกันของเรา คอยทวงให้เค้าสแกนส่งมาให้เราด้วยนะคะ เพราะต้องใช้
ขั้นตอนนี้จะรอให้ได้ case number ก่อนก็ได้ แต่ถ้ากลัวไม่ทัน มีแค่ NOA2 ก็ไปขอได้เลยค่ะ เพราะใช้เวลาอย่างน้อย 3 อาทิตย์กว่าจะได้ (ถ้าไม่ได้ใช้เส้นสายอะนะคะ) เราก็ไปขอก่อนได้ case number รายละเอียดเอกสารที่ใช้และสถานที่ต้องไปขอสามารถดูได้จากเว็บไซต์สถานทูตอเมริกาในไทยค่ะ  อันนี้คืออันที่เราดู แต่เช็คที่หน้าเว็บอีกทีนะคะ เผื่อมีการอัพเดทเปลี่ยนแปลงอะไร

2012 Jun 11         Case Number and Affidavit of Support (AOS) fee bill received by e-mail from NVC
Once NVC receives your case from USCIS, your case number and Affidavit of Support (AOS) fee bill will be issued. You will receive 2 e-mails, AOS fee bill and DS-3032. AOS fee bill will be addressed to your name and DS-3032 will be addressed to your alien spouse's name.
DS-3032 is a form for your alien spouse to appoint an agent to contact NVC on behalf of himself/herself. Normally your name and address will be put to be his/her agent. This means from this stage on, NVC will contact your alien spouse via you. Anyway, NVC nowadays seems to mostly contact you and your alien spouse via e-mail, so your alien spouse will always get a copy of each e-mail NVC sends to you.

ขั้นตอนนี้ NVC จะทำการส่งอีเมล์มา 2 ฉบับ ฉบับนึงชื่อผู้รับเป็น US citizen เป็น AOS fee bill ซึ่งหมายถึงว่า US citizen สามารถชำระค่า AOS (ค่าเอกสารที่สามีจะเป็นสปอนเซอร์ให้เรา) ได้แล้ว ก็ให้สามี/ภรรยาชาวเมกันไปดำเนินการจ่ายตาม instructions ที่ระบุในอีเมล์ได้เลย case number กะ invoice number อะไรต่างๆ จะอยู่ในนั้นหมด
อีกฉบับจะเป็น DS-3032 อันนี้จะส่งถึงชื่อของเราที่เป็นคู่สมรสชาวไทย หมายความว่าเราสามารถที่จะส่ง DS-3032 ซึ่งให้เราตั้ง agent ในการติดต่อกับ NVC และรับเอกสารแทนเราได้แล้ว โดยปกติเราจะใส่ชื่อและที่อยู่สามี/ภรรยาชาวเมกันของเราลงไปให้เป็น agent ของเราค่ะ หมายความว่าต่อจากนี้ NVC จะส่งเอกสารและติดต่อเราผ่านทางสามี/ภรรยาชาวเมกันของเรา แต่เดี๋ยวนี้ NVC เค้าติดต่อทางอีเมล์เป็นหลักค่ะ เพราะงั้นเราชาวไทยจะได้รับ copy ของอีเมล์แต่ละฉบับจาก NVC ด้วยค่ะ


2012 Jun 12         AOS fee bill paid by H and DS-3032 e-mailed to NVC by M
Pay the AOS fee bill online by following the instructions on the AOS fee bill. The url of the payment system to pay online will be found on the instructions. And your alien spouse sends DS-3032 to NVC via e-mail without using the form. See page 11 to see the template of the e-mail to send DS-3032 via e-mail.
เราชาวไทยต้องทำการส่ง DS-3032 กลับไปยัง NVC เพื่อตั้งสามี/ภรรยาชาวเมกันของเราให้เป็น agent ของเราตามที่บอกไว้ด้านบน ที่นี้เราจะทำการส่ง DS-3032 ไปทางอีเมล์นะคะ ขั้นตอนนี้สำคัญมาก ห้ามลืมส่งเด็ดขาด เพราะหลังจากเสร็จขั้นตอนนี้เรียบร้อยแล้วเราถึงจะสามารถส่งเอกสาร package ต่อไปได้
เราจะใช้วิธีส่ง DS-3032 ทางอีเมล์ เนื่องจากเร็วกว่า print แบบฟอร์มออกมาแล้วกรอกแล้วส่งทางไปรษณีย์เยอะ เพราะงั้นไม่ต้องไปสนใจแบบฟอร์ม DS-3032 ที่ NVC อีเมล์มาให้นะคะ สนแค่ case number พอ เพราะต้องใช้ในการส่งอีเมล์ การส่ง DS-3032 ทางอีเมล์นั้น จะต้องเขียนข้อความอะไรแบบไหน สามารถดูได้จาก template ข้างล่างเลยนะคะ (DS-3032 e-mail template) แล้วส่งไปที่ NVCINQUIRY@state.gov

2012 Jun 13         AOS fee bill status shown as paid
A day after you pay your fee bill online, log in again and you should see the status as PAID and also a button to print out AOS Barcode Cover Sheet. You will find instructions on what to do next for AOS here. US citizen is the person that will send AOS package to NVC. → See more info later on the date H sent his AOS package.

2012 Jun 20        DS-3032 receipt notice by NVC received by e-mail 
A week later you should receive an e-mail from NVC telling you they already receive your alien spouse's DS-3032.

2012 Jun 21        IV fee bill available to be paid and H paid the bill 
Once your alien spouse's DS-3032 is received by NVC, IV (Immigration Visa) fee bill will be generated and available for you to pay. Log into the payment system again to check and see if the bill is available, if so pay the bill.

2012 Jun 26        IV Package (DS-230 Package) sent to NVC by M from Thailand 
After you pay IV fee bill, log into the payment again to see if the status is PAID and also look for a button to print out Barcode Cover Sheet for your alien spouse's IV Package, if it’s there, tell your alien spouse to long in and print it out. This mean your alien spouse can mail your IV package to NVC now. You will also find what to do next and where to get the needed forms here. 
*Documents needed to be sent with IV Package are shown below. Your alien spouse should get everything ready by the time the barcode cover sheet is available.
These are what I sent with my IV package.
          1. Barcode Cover Sheet → print out from NVC system
          2. 2 Passport Size Photographs of myself (NVC Case Number, my full name, and date of birth are written on the back of both)
          3. DS-230 Part 1 completed and signed by me
          4. DS-230 Part 2 completed by me – unsigned, as of yet, per instructions
          5. Additional sheet for DS230 part I (No.13 Present Address, No.22 Father’s Current Address, No.27 Mother’s Current Address, No.32 Employment for the Last Ten Years) → extra sheet to fill what you can’t fill out in the form
          6. Photocopy of the Biographic Data Page of my Passport
          7. Original Birth Certificate of myself and a copy
          8. Original Marriage Certificate and a copy
          9. Original Police Certificate of myself and a copy
        10. Original Change of Name Deed of my mother and a copy → if either or both of your parents’ name is not the same as in your birth certificate, you will have to provide the evidence of the name change
         11. Cover Letter for IV package → look for the template below

ขั้นตอนนี้สำหรับชาวไทยเรานะคะ คือ หลังจากส่ง DS-3032 และ NVC ได้รับเรียบร้อยแล้ว NVC จะออก IV Fee Bill มาให้เราไปจ่ายตังค์ เมื่อจ่ายแล้วเราจะสามารถ print Barcode Cover Sheet ออกมาได้ ทำการ print ออกมานะคะ แล้วส่งไปพร้อมกับเอกสารตามรายการด้านบน ของเราส่งโดยใช้บริการของ DHL ใช้เวลา 3 วันจากไทยไปถึง NVC ที่เมกาค่ะ

2012 Jun 28          AOS Package (I-864 Package) sent to NVC by H from CA,
                                IV Package delivered at NVC
You mail NVC your AOS package. This can be done before, at the same time or after your alien spouse sends his/her IV package, depends on when it is ready. You can also find instructions on what to do and where to get the form on the payment system. You log into the payment system and print AOS Barcode Cover Sheet out to send with the AOS package.

2012 Jun 29         AOS Package delivered at NVC 
2012 Jul 05          M went to get medical check
Your alien spouse will need paper from the doctor on his/her interview date. Your alien spouse should do this when you receive an e-mail from NVC informing you the interview date (P4). He/She has to check at the US embassy in BKK website for the details on where he/she can meet the doctor to get the paper and what you need to do for the medical examination.

If he/she passes the medical examination, the medical paper will be good for 6 months and he/she will need to enter the US with your CR1 visa before the medical paper expires.

การตรวจสุขภาพควรทำเมื่อได้รับแจ้งวันสัมภาษณ์แล้ว เนื่องจากผลการตรวจสุขภาพมีวันหมดอายุอยู่ และเราควรเดินทางเข้าอเมริกาก่อนผลการตรวจสุขภาพหมดอายุ เพราะฉะนั้น หากไม่ได้วางแผนว่าจะเดินทางทันทีหลังได้รับวีซ่า ก็ควรวางแผนส่วนนี้ไว้ด้วย
CR-1 วีซ่านั้นมีอายุ 6 เดือนนับแต่วันออกวีซ่า แต่ผลการตรวจสัมภาษณ์หากปกติ จะมีอายุ 6 เดือนเช่นกัน ดังนั้น CR-1 วีซ่าของเราก็จะถูกผูกกับผลการตรวจสุขภาพ อธิบายง่ายๆ ตัวอย่างเช่น เราตรวจสุขภาพวันที่ 16 ม.ค. ผลออกมาปกติ จะเท่ากับว่าผลการตรวจสุขภาพของเราจะใช้ได้ถึง 15 ก.ค. แต่หากวันสัมภาษณ์วีซ่าของเรา คือ กลางเดือน ก.พ. และวีซ่าเราออกวันที่ 16 ก.พ. จะเท่ากับว่าเราต้องเดินทางเข้าเมกาก่อน 15 ก.ค. (ไม่ใช่ 15 ส.ค.) ซึ่งเป็นวันที่ผลการตรวจสุขภาพจะหมดอายุ เท่ากับว่าแทนที่เราจะมีเวลา 6 เดือนนับจากได้รับวีซ่าในการอยู่เมืองไทย เราจะมีเวลาแค่ 5 เดือนเท่านั้น
สิ่งที่ต้องนำไปในการตรวจสุขภาพคือ เอกสารที่แสดง case number ของเรา เนื่องจากหมอต้องกรอกลงในแบบฟอร์ม และแบบฟอร์มการตรวจสุขภาพ ซึ่งสามารถดาวน์โหลดและดูข้อมูลของ รพ. ที่เราจะสามารถไปทำการตรวจสุขภาพได้ที่เว็บไซต์ของสถานทูต

2012 Jul 09           “Checklist: AOS missing” received by e-mail 
We received this e-mail from NVC after H’s AOS package was already delivered at NVC. It says NVC already received my IV package but still waiting for AOS package from H. So H called the NVC call center and asked. They said this happened because it could take 10 days for NVC to open the package. So we just waited and then 2 days later we received an e-mail informing us the interview date in BKK.

We received an e-mail telling us the interview date and also telling us our case was done at NVC and being sent to US embassy in BKK.

2012 Jul 20         M traveled to visit H with B1/B2 visa in the US 
2012 Aug 14       M arrived back in Thailand 

2012 Aug 16       Interview appointment at US embassy in BKK 
On the interview date, your alien spouse will need to bring the letter of appointment, so print that out and bring it. Your alien spouse will also need to bring any evidence showing relationship between your alien spouse and you is real. This could be chat logs, call logs, photo albums showing your relationship from time to time, pictures of gifts you have given to each other, stamps on his/her passport and a copy of stamps of your passport showing you are visiting each other. If he/she has a current valid US visa in an old passport, he/she should also bring it. They will ask for it because they will cancel it. If he/she passes the interview, they will keep the current passport and the old one with the valid US visa and return some paper you send to them during USCIS and NVC steps to him/her.

ในวันสัมภาษณ์จะต้อง print ใบนัดวันสัมภาณษ์และถือไว้ในมือตอนต่อแถวด้านหน้าสถานทูตด้วยนะคะ เวลาเค้าขอดูแล้วถ้าเราสามารถให้เค้าดูได้ทันที เค้าจะให้เราเข้าก่อนคนที่มาก่อนเราแต่มัวแต่ค้นกระเป๋าหยิบใบนัดให้เค้าดูไม่เจอสักที
สิ่งที่ต้องเอาไปในวันสัมภาษณ์นอกจากใบนัดก็มี ทะเบียนบ้านตัวจริง บัตรประชาชน พาสปอร์ตเล่มเก่าๆ ถ้ามีวีซ่าเมกาอยู่ และมี stamp เข้าออกเมกาตอนเราไปเยี่ยมแฟนหรือสามี เอกสารอื่นๆ ที่แสดงความสัมพันธ์ที่มีมาอย่างต่อเนื่อง เช่น ภาพถ่าย บันทึกการคุยผ่านอินเทอร์เน็ตตามช่องทางต่างๆ บันทึกการโทรศัพท์ sms โปสการ์ด เป็นต้น เอาใส่แฟ้มเอกสารขนาดไม่หนาและใหญ่เกินนะคะ เพราะต้องสอดเข้าช่องแคบๆ เล็กๆ ตรงเคาน์เตอร์ กระดาษขนาด A4 หนาไม่เกิน 1 นิ้ว สามารถสอดเข้าช่องได้แน่นอนค่ะ เพราะงั้นถ้ามันเยอะก็แบ่งเป็นหลายๆ เล่ม แต่ไม่อยากจะบอกเลยว่า ไม่จำเป็นต้อง print อะไรไปเยอะแยะ อีเมล์ก็ print แค่รายการอีเมล์ไปก็พอค่ะ ไม่ต้อง print เนื้อหาอีเมล์แต่ละฉบับไปด้วย ถ้าอยาก print ก็เลือกแค่ฉบับสำคัญๆ ก็พอ เพราะกงสุลท่านไม่อ่านหรอกค่ะ แค่พลิกไปพลิกมาเล่มละ 2-3 ทีเอง

2012 Aug 17 CR1 visa issued and B1/B2 visa in M's passport canceled 
2012 Aug 18 Passport with CR1 visa and CR1 package received at M’s address 
2 days after the interview, my passport and my visa package was mailed to my house. Here in Thailand, they have changed the way to send the passport and the package back by mail only since July 2012. Your alien spouse will receive 2 things from the embassy, his/her passport with CR-1 visa and a sealed big brown envelope. Don’t open the envelope. He/She will need to give it to the immigration at the airport in the US when he/she enter the US with CR-1 visa.

ก่อนทำการสัมภาณษ์ จนท. จะให้เราไปจ่ายค่างไปรษณีย์ ซึ่งจะผ่านหรือไม่ผ่านการสัมภาษณ์ก็ต้องจ่ายทุกคน จำนวนเงินจำไม่ได้ แต่ให้เตรียมเงินสดติดตัวเข้าไปด้วย 500 บาท เมื่อสัมภาษณ์ผ่านแล้วประมาณ 2 วัน (ถ้าไม่คิดวันหยุด) ไปรษณีย์จะเอาเอกสารมาส่ง ในกล่องเอกสารจะมีพาสปอร์ตเก่ากะใหม่ของเรา ในพาสปอร์ตเก่าที่หน้าวีซ่า B1/B2 มีปั๊ม CANCELLED ตัวบะเริ่ม ส่วนในเล่มใหม่มีวีซ่า CR-1 แปะอยู่ นอกจากนี้ก็มีเอกสาร 5 - 6 แผ่น ให้รายละเอียดการเข้าเมกาและบัตรประกันสังคม และสิ่งสุดท้ายคือเอกสารในซองสีน้ำตาลปิดผนึกและมีคำเตือนว่าห้ามเปิด เอกสารซองน้ำตาลนี้เราจะต้องถือไปยื่นให้ จนท. ตม. ตอนเข้าเมกา ห้ามแกะเด็ดขาด จนท. ตม. จะเป็นคนแกะค่ะ
